Exposé sommaire : Cet amendement du groupe Socialistes et apparentés entend supprimer la mention de la fidélité dans l'article énumérant les obligations résultant du mariage. Une telle obligation légale n'existe ni dans le cadre du Pacs, ni dans le cadre du concubinage. L'évolution de notre société tend à faire de la fidélité une question morale appartenant à chacun et non une obligation légale imposée à tous. L'article 212 du code civil serait ainsi rédigé : "Les époux se doivent mutuellement respect, secours, assistance".
