Dispositif : Compléter l'alinéa 56 par la phrase suivante : « Ce meilleur contrôle passe également par le renforcement du délit de séjour irrégulier. ». Exposé sommaire : La population totale de Mayotte est estimée à 321 000 personnes au 1er janvier 2024. Selon l'INSEE, près de 50 % de cette population serait étrangère, dont 50 % en situation irrégulière. Ce constat illustre l'ampleur exceptionnelle de la pression migratoire que subit l'archipel. Ainsi, cet amendement vise à compléter le dispositif de lutte contre l'immigration illégale en affirmant un principe essentiel pour la restauration de l'autorité de l'État : le renforcement du délit de séjour irrégulier. Il s'agit d'un outil juridique indispensable pour renforcer la capacité de l'État à lutter efficacement contre l'immigration clandestine, dans un département particulièrement exposé à une pression migratoire sans équivalent sur le territoire national. Le Rassemblement National réclame de longue date le rétablissement du délit de séjour irrégulier sur l'ensemble du territoire national. Si ce projet de loi ne permet pas d'en débattre à l'échelle nationale, il offre en revanche l'opportunité de répondre à la situation actuelle que connaît Mayotte. C'est pourquoi nous proposons, a minima, le renforcement de ce dispositif sur ce territoire, confronté à une pression migratoire hors norme.
