Exposé sommaire : Cet amendement vise à qualifier avec justesse la nature de l'immigration clandestine à Mayotte. Ce choix n'est ni excessif ni rhétorique : il repose sur des faits précis et chiffrés, qui attestent une situation dramatique dans ce département. Depuis 2021, au minimum 60 000 migrants (selon les chiffres officiels) sont entrés ou ont tenté d'entrer illégalement à Mayotte via des filières structurées de passeurs. En 2023, 24 467 reconduites à la frontière ont été effectuées, 8 669 interpellations en mer ont été recensées, 22 732 interpellations ont eu lieu à terre, 965 kwassas ont été détectés, et 701 constructions illégales ont été détruites sur plusieurs communes de l'Ile (rapidement reconstruites). Malgré ces efforts, la situation reste totalement hors d'échelle. D'après la préfecture de Mayotte, près de la moitié de la population de l'île serait de nationalité étrangère, soit entre 140 000 et 150 000 personnes selon les chiffres officiels qui sont largement sous-estimés. Parmi elles, 70 000 à 100 000 vivraient en situation irrégulière, soit jusqu'à un habitant sur deux dans certaines zones (là aussi, les chiffres sont sous-estimés). Ces données démontrent l'inefficacité des dispositifs actuels à endiguer une immigration clandestine massive et incontrôlée, qui fragilise profondément le tissu social, sature les infrastructures publiques, alimente l'économie informelle et aggrave l'insécurité.
