Dispositif : À l'alinéa 3, supprimer le mot : « directement ». Exposé sommaire : La montée continue de la délinquance des mineurs étrangers à Mayotte constitue un défi majeur. Entre 2019 et 2024, leur part parmi les mineurs condamnés à Mayotte a progressé de 110 %. Ils sont surreprésentés dans les infractions les plus graves : 41 % des mis en cause pour homicide, 30 % pour viols ou tentatives de viols, contre respectivement 18 % et 5 % dans l'ensemble du pays. Cette situation particulière, dans un département confronté à une forte pression migratoire et à des déséquilibres démographiques persistants, impose des réponses juridiques adaptées. A cet égard, le présent amendement vise à renforcer ce dispositif pour répondre de manière ferme à ce phénomène. Ainsi, il est proposé de supprimer l'exigence d'un lien de causalité direct entre les manquements du parent et la menace causée par le comportement du mineur, cette formulation vidant la mesure de sa portée. En introduisant une condition de lien direct, le texte impose une interprétation étroite de la causalité, qui risque d'exclure des situations où le manquement parental a pourtant contribué de manière significative, bien que non exclusive, au comportement fautif. C'est pourquoi cet amendement écarte l'exigence d'un lien de causalité trop rigide.
