Dispositif : À la fin de l'alinéa 43, substituer les mots : « la restriction des conditions d'accès à la nationalité française » les mots : « « sa suppression à Mayotte. » Exposé sommaire : Cet amendement propose de réécrire la fin de l'alinéa 43 afin d'inscrire clairement la suppression du droit du sol à Mayotte. Il s'agit d'une mesure de rupture et de bon sens, destinée à mettre un terme à l'instrumentalisation du droit du sol comme vecteur d'installation migratoire, et à restaurer le sens de la nationalité française. Le droit du sol, comme l'a constaté le député Yoann Gillet dans son rapport parlementaire n°471, constitue une incitation à l'immigration et un appel d'air qui fragilise la politique migratoire de la France. Le cas de Mayotte illustre de manière flagrante les dérives actuelles. L'île est soumise à une pression migratoire d'une ampleur inédite. Selon une étude de l'Institut national d'études démographiques (INED) parue en 2018, 42 % des naissances dans le département sont issues de deux parents étrangers. Cette dynamique encourage les arrivées illégales de femmes enceintes dans le seul but de faire naître leur enfant en France et d'ouvrir par la suite un droit au séjour. Ainsi, la suppression du droit du sol constitue une mesure ferme, destinée à soulager les services hospitaliers saturés, à rétablir la maîtrise de notre politique migratoire, et à préserver la stabilité démographique et sociale sur le territoire français.
