Exposé sommaire : Le présent amendement vise à définir clairement les « salariés expérimentés » comme les personnes âgées de 55 ans ou plus, afin d'aligner le champ d'application des futures négociations collectives sur la réalité sociale du marché du travail. En l'état, la formulation retenue par le projet de loi « salariés expérimentés, en considération de leur âge » reste floue et ouvre la voie à des interprétations restrictives. Or, l'éviction du marché du travail frappe bien plus tôt : dès 55 ans, les taux de retour à l'emploi chutent drastiquement, les durées de chômage s'allongent, et les opportunités professionnelles se raréfient. Redéfinir la notion de salarié expérimenté à partir de 55 ans permettrait ainsi de recentrer les obligations de négociation sur les publics réellement fragilisés, et de déclencher plus en amont des mesures de maintien dans l'emploi, de formation ou de transition.
