Cet amendement souhaite que le décret d'application des 4° et 5° du I s'applique dans les six mois et non 18 mois après la promulgation de la présente loi. En résumé, les 4° et 5° du I visent à ce que le conducteur ne loue pas ou ne cède pas son attestation de VTC. Cette situation ubuesque dure depuis des années et doit être réglée au plus vite. Aussi, pourquoi attendre jusqu'au 18e mois suivant la promulgation de la présente loi ? Ce projet de loi fraude a été déposé au sénat le 14 octobre 2025. Cela fait donc plusieurs mois que les acteurs du VTC sont prévenus que l'article 8 sera contraignant et les obligera à rectifier un certain nombre de pratiques frauduleuses. La location ou le prêt d'attestation VTC peut mettre en danger les clients des VTC et génère une fraude qu'il faut combattre. Ajoutons que la fraude des VTC représente un manque à gagner colossal pour l'État. Citons notamment le fait que le 2 février 2026 l'URSSAF a réclamé 1,7 milliards d'euros à Uber invoquant le fait que la plateforme "a maquillé sciemment une relation salariale en contrat d'entreprise pour échapper à ses obligations d'employeur" entre 2019 et 2022. Il faut donc que les plateformes de VTC se mettent en conformité le plus rapidement possible.
