Exposé sommaire : Cet amendement de repli des députés socialistes et apparentés vise à ne pas rendre automatique les sanctions à la fraude aux prestations sociales. Tout d'abord, la constitutionnalité de l'automaticité des sanctions nous interroge fortement, notamment en ce qu'elle ne semble pas respecter le principe d'individualisation des peines. Ensuite, nous n'avons pas trouvé lors de l'examen en Commission des Affaires sociales une telle prévenance de la part du socle commun et de l'extrême-droite à réprimer plus durement la fraude aux cotisations sociales. Pour ces raisons, il convient de ne pas rendre automatique les sanctions à la fraude aux prestations sociales.
