Exposé sommaire : Les critères de recrutement des citoyens-assesseurs ne garantissent nullement l'aptitude de telles recrues à siéger au sein de la cour criminelle. En effet, ni un diplôme de BAC+3, ni une “expérience de cinq années qualifiant pour l'exercice d'une fonction judiciaire pénale” n'équivaudront à une formation professionnelle dans l'école d'application qu'est l'école nationale de la magistrature. La dérive évidente de cet alinéa 39 est d'offrir une opportunité de rémunération durant cinq ans à des personnes qui n'ont pas présenté avec succès les concours de la fonction publique. De plus, ces citoyens-assesseurs renvoient l'image d'une justice au rabais qui se contentera de payer à la vacation des “sous magistrats” recrutés en fonction de critères sans aucune pertinence, au regard des exigences qu'implique la fonction de juger.
