Exposé sommaire : Cet article intervient dans un domaine qui relève traditionnellement de la réglementation propre à chaque discipline sportive. Les mécanismes d'encadrement de la masse salariale des sportifs professionnels, déjà mis en œuvre de manière effective au sein des différentes disciplines, sont définis par les règlements internes des fédérations et des ligues concernées et contrôlés par les organes de contrôle de gestion compétents. En inscrivant dans la loi un seuil uniforme applicable à l'ensemble des disciplines, cette disposition méconnaît la diversité des modèles économiques, des niveaux de revenus et des équilibres sportifs propres à chaque sport professionnel. Une telle approche risque de priver les acteurs concernés de la souplesse nécessaire pour adapter leurs règles aux spécificités de leur environnement. Par ailleurs, la fixation par la loi d'un quantum identique pour toutes les disciplines pourrait entraîner des conséquences significatives sur la compétitivité des clubs français, dont l'impact variera fortement selon les sports. Elle est susceptible de fragiliser leur capacité à attirer et retenir les meilleurs talents et, par conséquent, de nuire à leur performance sur la scène européenne et internationale.
