Exposé sommaire : Il convient de préserver la répartition actuelle des responsabilités en matière de contrôle des changements d'actionnariat des clubs professionnels. Ces opérations doivent continuer à relever de l'appréciation des organes de contrôle de gestion indépendants, dont l'expertise et les compétences sont spécifiquement consacrées à l'examen de la solidité financière, de la gouvernance et de la viabilité des projets présentés. Faire intervenir directement le ministre des Sports dans ce processus reviendrait à lui faire porter la responsabilité de décisions qui relèvent d'une analyse technique et indépendante. Une telle évolution serait de nature à brouiller la distinction entre les fonctions de régulation de l'État et les missions de contrôle confiées aux instances compétentes. En outre, les organes de contrôle de gestion disposent déjà de la faculté de solliciter l'avis ou le concours des services de l'État lorsqu'ils l'estiment utile dans le cadre de l'instruction des dossiers. Ce dispositif permet d'assurer la prise en compte des enjeux d'intérêt général tout en préservant l'indépendance et la cohérence du processus décisionnel.
