Dispositif : À l'alinéa 2, rétablir le 1° dans la rédaction suivante : « Après le premier alinéa de l'article 230‑10, il est inséré un alinéa ainsi rédigé : « Par dérogation, les agents affectés dans les services spécialement chargés des enquêtes en matière de délinquance et de criminalité organisées mentionnés à l'article 706‑80 A du présent code sont réputés être habilités à accéder à toute information figurant dans les traitements de données mentionnés au premier alinéa du présent article. » Exposé sommaire : Par le présent amendement est il proposé de revenir sur les modifications apportées à cet article par l'adoption en commission des amendements identiques CL493 et CL 593. En effet, ces amendements ont supprimé la présomption d'habilitation des enquêteurs affectés aux services spécialisés chargés des enquêtes en matière de délinquance et de criminalité organisée à accéder aux informations figurant dans les fichiers d'antécédents judiciaires (le TAJ). Or, cette mesure constituait une avancée importante, permettant aux enquêteurs un gain de temps et donc d'efficacité considérable. Il est donc proposé par cet amendement de rétablir cette mesure.
