Exposé sommaire : Cet amendement du Groupe Socialistes vise à engager une réflexion aussi sérieuse que possible sur l'incrimination de "contrôle coercitif". Consacrée par un arrêt de la Cour d'appel de Poitier en date du 31 janvier 2024, cette notion a nourri la présente proposition de loi puisque son article 3 y était initialement consacré. Les discussions en Commission des lois ont permis de soulever des interrogations légitimes sur les avantages et inconvénients de cette reconnaissance légale. En outre, l'observatoire des litiges judiciaires a ouvert son premier collège thématique sur cette notion en septembre 2024. Aussi cet amendement propose t-il qu'une réflexion soit menée sérieusement sur ce sujet.
