Exposé sommaire : Cet amendement du groupe Socialistes et apparentés vise à supprimer l'article 2 qui prévoit d'abaisser de 500 à 250 participants le seuil à partir duquel les rassemblements festifs à caractère musical seraient soumis à une obligation de déclaration préalable. Cet article aurait pour conséquence d'étendre le délit créé à l'article 1er aux organisateurs de rassemblements de faible envergure, ce qui ne semble ni souhaitable au regard du principe de proportionnalité des délits et des peines, ni efficace, dans la mesure où il n'est pas démontré que ces rassemblements de faible envergure poseraient des difficultés particulières. Enfin, la fixation de ce seuil relève du domaine réglementaire et non de la loi. Aussi, il est proposé de supprimer cet article afin de maintenir le seuil actuel fixé à 500 participants.
