La responsabilité pour trouble anormal de voisinage, consacrée par la jurisprudence et désormais codifiée à l'article 1253 du code civil, constitue un fondement juridique régulièrement invoqué dans les litiges opposant riverains et exploitants agricoles. Toutefois, dans le contexte agricole, ce régime de responsabilité est parfois mobilisé de manière abusive, et la rédaction actuelle du 311-1-1 porte une forme d'accusation sur les exploitants agricoles, sans que leur caractère réellement anormal ne soit toujours établi judiciairement. Cette situation peut fragiliser juridiquement des exploitations agricoles pourtant conformes aux réglementations en vigueur et participant à l'activité économique et à la vitalité des territoires ruraux. La substitution du terme « anormal » par le terme « allégué » vise ainsi à mieux refléter la réalité contentieuse de ces situations, dans lesquelles le trouble est avant tout affirmé par une partie avant d'être, le cas échéant, caractérisé par le juge. Cette évolution rédactionnelle permet de rappeler que la qualification d'un trouble relève de l'appréciation juridictionnelle et ne saurait être présumée du seul fait de son invocation. Elle contribue également à sécuriser juridiquement les activités agricoles, qui s'exercent par nature dans un environnement susceptible de générer certaines nuisances inhérentes à la production agricole, tout en maintenant la possibilité pour le juge d'apprécier souverainement la réalité et la gravité des troubles invoqués. Ainsi, cette modification rédactionnelle participe d'un objectif d'équilibre entre la protection des riverains et la nécessaire préservation des activités agricoles.
